Report: Appeals court upholds eBay victory in Tiffany counterfeit case

San Jose, Calif. An appeals court ruled that eBay is meeting its responsibilities in fighting counterfeiting under trademark law and upheld an earlier dismissal of trademark infringement claims that had been brought by Tiffany & Co., according to the Silicon Valley/San Jose Business Journal.

The Second Circuit Court of Appeal’s ruling affirmed a lower court’s ruling in favor of eBay.

Tiffany, which had argued that eBay was aware that counterfeit items were sold through its site and did little to solve the problem, said it might appeal to the Supreme Court.

EBay won similar cases in French and British courts over counterfeit L'Oreal products.
