Dillard's wins licensing lawsuit against i2 Technologies

Little Rock, Ark. Dillard’s said late Thursday that a jury in Dallas County, Texas, awarded the department-store retailer as much as $246 million in its licensing lawsuit against i2 Technologies, a division of JDA software that makes inventory management software.

Dillard’s filed the software licensing lawsuit against i2 for fraud, breach of contract and breach of warranty, claiming that i2 Technologies failed to meet its obligations under a licensing agreement for which Dillard’s paid about $8 million.

The jury in state district court rejected i2's counterclaims against Dillard's in reaching its decision. JDA Software may have to pay Dillard's as much as $246 million -- a reimbursement of the $8 million investment Dillard’s made plus another $238 million in indirect or punitive damages.

JDA said it will seek to have the decision reversed. "We believe this verdict is unjustified given the nature of this commercial dispute," JDA CEO Hamish Brewer said in a statement. "We will pursue every avenue available to overturn the verdict, and are confident that justice will ultimately prevail."
